These Terms of Service govern your use of the Ftouni Aura website and any purchase made through our online store.
Throughout these Terms, “Ftouni Aura”, “we”, “us” and “our” refer to the operator of the Ftouni Aura online store.
By accessing our website, purchasing a product, creating an account, or otherwise using our services, you agree to these Terms of Service.
If you do not agree with these Terms, you should not use our website or purchase our products.
1. ONLINE STORE TERMS
By using this website, you confirm that you are legally capable of entering into a binding agreement under the laws applicable to you.
If you are under the legal age of majority in your jurisdiction, you may only use the store with the involvement and consent of a parent or legal guardian.
You may not use our products, website or services for any unlawful or unauthorized purpose.
2. PRODUCTS
Ftouni Aura sells apparel and related fashion products, including printed garments.
We make reasonable efforts to display product photographs, colors, specifications, sizes and descriptions accurately.
However, actual colors may vary slightly due to:
• Screen settings
• Lighting
• Printing methods
• Fabric color
• Production batches
• Photography and digital mockups
Minor variations that are normal for printed garments are not necessarily considered defects.
Minor print, garment, shade, measurement and manufacturing variations within reasonable production tolerances are not automatically defects or grounds for a refund. This does not permit material departures from stated specifications or limit rights relating to material defects or non-conformity.
Except where a defect existed at delivery or applicable law requires otherwise, shrinkage, fading, cracking, peeling, discoloration, deformation or similar damage caused by improper washing, drying, ironing, bleaching, chemicals, excessive heat, abrasion, alteration, misuse, normal wear or failure to follow care instructions is not a product defect. This does not exclude a claim arising from an underlying defect, inadequate care instructions or a failure to meet legally required durability or quality standards.
3. PRODUCT IMAGES AND MOCKUPS
Certain images displayed on our website may be digital product mockups intended to demonstrate the appearance, artwork and approximate placement of a design.
The final physical product may contain minor differences in print position, scale, tone or appearance.
Some product, lifestyle, campaign, model, background or presentation images may be digitally created, digitally enhanced, composited, rendered, or generated in whole or in part using AI or design software. These images are visual representations and may not depict a photographed physical sample in every case.
Final physical products may not match website imagery with absolute 100% precision. Reasonable variations may occur in print placement, print scale, color tone, saturation, edge sharpness, texture, garment shade, fabric appearance, proportions, lighting and other non-material visual details.
Customers should rely on the written product description, selected variant, applicable size guide and stated specifications in addition to imagery. Styling elements, models, props, scenery, backgrounds and accessories shown are not included unless expressly stated.
Material differences, defects or incorrect products are handled according to our Return & Refund Policy and applicable consumer law.
These explanations do not excuse materially incorrect, defective, misdescribed or non-conforming products or override any legally binding product descriptions or representations.
4. PRICES
All prices displayed on our store are shown in the currency selected for the applicable market.
Prices may change at any time without prior notice.
A price change does not affect an order that has already been validly placed and accepted.
Shipping costs, taxes, duties or other charges may apply depending on the customer's destination.
Applicable charges that we collect will be displayed during checkout where possible.
5. PAYMENTS
Payment must be successfully authorized before an order can be processed.
Payments may be processed through Shopify Payments, PayPal or other authorized payment providers.
Ftouni Aura does not directly store full payment-card details.
Payment providers may apply their own terms, security checks and fraud-prevention procedures.
6. ORDER ACCEPTANCE
Receiving an order confirmation does not necessarily mean that we have accepted the order for fulfillment.
We reserve the right, where legally permitted, to cancel or refuse an order for reasons including:
• Suspected fraud
• Payment failure
• Incorrect pricing
• Product unavailability
• Shipping restrictions
• Incorrect customer information
• Technical errors
• Suspected resale or abuse
• Legal or regulatory restrictions
If we cancel a paid order, any amount owed back to the customer will be refunded to the original payment method.

Your order may therefore be produced or shipped from a location different from Ftouni Aura's business location.
By purchasing from our store, you acknowledge that fulfillment may be performed by third parties on our behalf.
Ftouni Aura remains responsible for its obligations to customers to the extent required by applicable law.
9. SHIPPING
Shipping availability, estimated delivery times and charges are shown during checkout or described in our Shipping Policy.
Delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.
International shipments may experience delays caused by:

• Security inspections
• Transportation disruptions

10. CUSTOMS, DUTIES AND IMPORT FEES
Depending on the destination and shipping arrangement, an order may be subject to customs duties, import taxes, handling fees or other governmental charges.
Where these amounts are not collected by Ftouni Aura during checkout, the customer may be responsible for paying them directly.
Any mandatory disclosure or payment obligations under applicable law will continue to apply.
11. RETURNS, REFUNDS AND CANCELLATIONS
Returns, refunds, replacements and order cancellations are governed by our Return & Refund Policy.
Our Return & Refund Policy forms part of these Terms of Service.
Where applicable law permits the merchant to choose the remedy, Ftouni Aura may select a commercially reasonable remedy, such as replacement, reshipment, partial refund or full refund, appropriate to the circumstances and consistent with its legal obligations. Where the law gives the customer the choice of remedy, that mandatory law controls.
Nothing in these Terms restricts a customer's lawful right to contact a bank, card issuer or payment provider or to use an available dispute process. To the extent permitted by law, a customer should not receive duplicate reimbursement for the same loss through a refund, replacement or credit from Ftouni Aura and a chargeback, card-network, payment-provider or insurer recovery. We may provide evidence of a prior remedy or seek recovery of duplicated amounts where legally permitted. This does not prevent recovery for a separate loss or an inadequate remedy.
Nothing in these Terms removes any consumer right or legal remedy that cannot lawfully be excluded.
12. SIZING
Customers should review the applicable size guide before purchasing.
Sizing may differ from other clothing brands.
Except where required by applicable law, selecting an incorrect size does not automatically entitle a customer to a refund or exchange.
13. INTELLECTUAL PROPERTY
All content on the Ftouni Aura website, including where applicable:
• Brand names
• Logos
• Artwork
• Graphic designs
• Product designs
• Photographs
• Videos
• Written content
• Layouts
• Marketing materials
is owned by, licensed to, or otherwise lawfully used by Ftouni Aura.
No content may be copied, reproduced, distributed, sold, commercially exploited or used to create competing products without appropriate authorization.
14. PRODUCT ARTWORK
Artwork appearing on Ftouni Aura products is provided for purchase as part of the physical product only.
Purchasing a product does not transfer copyright, trademark rights, licensing rights or other intellectual-property rights in the artwork to the customer.
15. PROHIBITED USES
You may not use our website or services to:
• Violate any law
• Commit fraud
• Submit false information
• Interfere with website security
• Introduce malware or malicious code
• Scrape or reproduce store content without authorization
• Impersonate another person
• Abuse payment systems
• Make knowingly fraudulent claims
• Attempt unauthorized access to our systems
• Infringe intellectual-property rights
We may restrict access where reasonably necessary to protect the store, customers or our legal interests.
16. ACCURACY OF INFORMATION

Requests will be proportionate to the issue and will not impose an evidentiary requirement contrary to applicable law.
We may investigate altered evidence, false damage claims, deliberate product damage, repeated abusive refund requests, chargeback abuse or claims inconsistent with available records. An investigation or a history of prior claims does not, by itself, establish fraud or justify denying a legitimate statutory remedy. These measures do not restrict legitimate statutory rights.
24. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Ftouni Aura will not be liable for indirect, incidental, special or consequential losses arising from use of the website or products.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
In particular, nothing in these Terms limits mandatory rights relating to defective goods, personal injury, fraud or other liabilities that cannot legally be excluded.
25. NO WAIVER OF CONSUMER RIGHTS
Nothing in these Terms is intended to remove, restrict or replace mandatory consumer rights.
Customers may have additional rights depending on their country or region.
Where these Terms conflict with a mandatory consumer-protection law applicable to the transaction, that mandatory law will apply.
26. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify Ftouni Aura against claims, losses or expenses resulting from your unlawful use of the website, violation of these Terms, or infringement of another person's rights.
This clause does not limit any mandatory consumer rights.
27. FORCE MAJEURE
Ftouni Aura will not be responsible for delays or failures caused by circumstances reasonably outside our control, including:

The version published on our website at the time of an order will generally govern that transaction, subject to applicable law.
Continued use of the website after updated Terms are published constitutes acceptance of the updated Terms for future use.
31. GOVERNING LAW
These Terms are generally governed by the applicable laws of the United Arab Emirates, subject to any mandatory consumer rights or jurisdictional protections that apply to customers in their country or region.
Nothing in this section deprives a consumer of protections that cannot legally be waived.
32. DISPUTE RESOLUTION
If you have a complaint or dispute, please contact us first so that we can attempt to resolve the matter directly.
Nothing in these Terms prevents a customer from using a court, regulator, consumer-protection body, payment provider or dispute-resolution process where the customer has a legal right to do so.

form the agreement governing purchases from Ftouni Aura.
